NASHVILLE, Tenn. - A Wilson County grand jury indicted a Tennessee Highway Patrol trooper who left the department earlier this year after allegedly engaging in a sex act with a motorist.
James Randy Moss resigned after a porn actress revealed she had sex with him on a traffic stop.
Moss now faces charges in connection with that stop and another one involving a second woman.
Moss turned himself in to the Wilson County Jail after a grand jury handed up a 10-count indictment against him.
The Tennessee Bureau of Investigation found enough evidence to charge Moss in two separate incidents.
"I'm certainly not agreeing that what he did was a criminal offense, but he recognizes that he made an error in judgment," said Jack Lowery, the former trooper's attorney.
The indictment charges Moss with tampering with evidence, official misconduct and intimidation.
The charges stem from two traffic stops. One of them involved the highly publicized stop of porn actress Barbie Cummings, whose rela name is Justis Richert, in May.
Cummings said Moss got rid of her illegal prescription painkillers and her "thank you" was of a sexual nature. Moss cited her for speeding.
The other traffic stop involved a woman in September 2006.
A TBI spokeswoman said the situation was similar.
"He would pull a female over, inappropriately approach her in a sexual nature, and if the female would cooperate with him then he would tell them he would some how lessen her punishment," said Kristin Helm, a TBI spokeswoman.
The TBI uncovered the woman's complaint during an investigation after the Barbie Cummings stop.
"We went back and looked at all the prior complaints Officer Moss had against him as well as pulled all the videotapes from traffic stops out of his patrol car," Helm said.
Lowery said Moss will plead not guilty to all of the charges.
"He's not seeking to do anything, but to get on with his life and take care of his family," Lowery said.
The most serious charge against Moss is tampering with evidence, a Class C felony.
The punishment with no prior convictions is less than a year in prison and a $10,000 fine.
Court officials said me they would be surprised if this case goes to trial.
Moss is scheduled to enter a plea in court Nov. 21.
