Trial Seated In Mary Winkler Trial

Just before 6:00 p.m. Wednesday, a jury was seated in the trial of Mary Winkler in Selmer, Tenn. The jury contains four men and 12 women, totaling 16, which provides for four alternates. The jury will be sequestered throughout the trial.

Winkler's defense lawyers Steve Farese and Leslie Ballin said Tuesday that they expected to complete the jury selection process Wednesday and begin opening statements Thursday. 

The trial could last more than a week. The judge decided Wednesday to continue court proceedings on Saturday to speed along the process.

They also released their witness list Tuesday. They focused on calling character witnesses up to the stand, but they have also subpoenaed the family doctor, the sheriff and the main investigator in the case.

Mary Winkler is charged with first degree murder in the shooting death of her husband Matthew Winkler who was the preacher at the Fourth Street Church of Christ in Selmer. 

The attorneys acknowledge they won't be able to find jurors who haven't heard or participated in the buzz surrounding the case in this small West Tennessee town. 

Defense attorneys may try to argue that she shot her husband by accident. 

They asked potential jurors yesterday whether they thought guns could discharge accidentally and whether they thought it was unusual for a woman to know how to load a firearm. 

Members of Matthew Winkler's Church of Christ congregation found him when they came to the parsonage after he missed a Wednesday evening church service in March 2006. 

Police found Mary Winkler and the couple's three young daughters the next day on the Alabama Gulf coast, some 340 miles away from Selmer.
