MURFREESBORO, Tenn.- The new prosecutor in the case of a Rutherford County sheriff's deputy charged with hitting and killing an 11 year-old girl isn't ready to call for an independent investigation.

Former Williamson County District Attorney Joe Baugh said he will speak with the victim's family before deciding what steps to take.

Baugh was assigned to the case after D.A. Bill Whitesell stepped down. White's family asked for a special prosecutor, and for the THP to take over the investigation.

Lt. Ron Killings was on duty and driving an unmarked county car at about 8:45 p.m. when the child was struck as she crossed a street to return to her aunt's home after visiting her grandmother.

A bottle of premixed margaritas was recovered by a witness who told police he saw Killings dispose of it.

Investigators initially ignored witness claims about the liquor bottle, but police took possession of it July 28.

Middle Tennessee Medical Center analyzed blood samples and the Tennessee Bureau of Investigation concluded that neither alcohol, nor drugs were in Killings' blood at the time of the crash.
