Who Pays For Water Main Break Damages?


NASHVILLE, Tenn. - A cold spell in early January left behind a huge icy mess in downtown Nashville, and now there's controversy over who will pay for the cleanup.

Many merchants along Second Avenue had to close their doors after six water main breaks last week. Now, Metro's legal department said the city is not liable for any damages because it was not a problem with the infrastructure but rather caused by the prolonged freezing temperatures.

Merchants have been disputing that claim - citing Metro's quick decision to update the more than century-old pipe system following the breaks.

Metro has currently been receiving bids on the first phase of the multi-million project to replace the downtown water lines.
