ELIZABETHTOWN, Ky. (AP) - The family of a slain woman has filed a wrongful death suit against her former husband, who had murder charges against him dismissed earlier this year after four mistrials.
The suit against Brent Burke was filed by his estranged wife's brother and her two children.
The complaint filed Friday alleges Burke's "intentional, willful and malicious use of a deadly weapon" caused the deaths of Tracy Burke and her former mother-in-law, Karen Comer, The News-Enterprise reports.
The women were shot to death at Comer's home in Rineyville in 2007.
After four mistrials, charges against Burke in Hardin County were dismissed. Prosecutors said there is a lack of physical evidence.
Burke has since been charged in military court with murder and burglary. He will face general court martial February 6.
