NASHVILLE, Tenn. – The case against State Representative Curry Todd, Jr. on DUI and gun charges has been held over to the grand jury after a hearing Tuesday.
The Collierville Republican was arrested in a neighborhood near Vanderbilt and Belmont universities on October 11. Police said Todd failed a sobriety test during a traffic stop and refused to take a breathalyzer.
A loaded Smith & Wesson 38 Special was found in a holster stuffed between the driver seat and the center console.
Todd was booked into jail on charges of driving under the influence and possession of a handgun while under the influence.
During Tuesday's hearing, Todd appeared in court and waived his right to a preliminary hearing.
The retired Memphis police officer was the main architect of a new state law allowing handgun carry permit holders to be armed in bars and restaurants that serve alcohol.
After his arrest, Todd resigned as chairman of the House State and Local Government Committee, but continued to serve as a state representative.
The date of the grand jury was not set.
