MURFREESBORO, Tenn. (AP) - A Murfreesboro judge has blocked local officials from issuing an occupancy certificate for a new mosque.
Rutherford County Chancellor Robert Corlew last month voided construction approval for the Islamic Center of Murfreesboro because the county did not provide proper notice for the meeting where it was approved.
However, county officials have not acted to stop mosque construction.
At a Wednesday hearing, plaintiffs asked Corlew to order county officials to do so.
Corlew declined, saying his ruling was not enforceable until after a 30-day appeal period. The Planning Commission voted on Monday to appeal. The County Commission will take up the issue Thursday.
Corlew did grant an injunction preventing the county from taking new actions to forward mosque construction. He later clarified that the county could not grant an occupancy certificate.
The issue over occupancy of the building will come back up for a hearing on July 2.
