New Developments In Cold Case Of Marcie Smith

RUTHERFORD COUNTY, Tenn. - The prime suspect in a high profile cold case was ordered to report to the Rutherford County jail.

"This is just one step in the process," said Kyle Evans with the Murfreesboro Police Department.

Sheriff's deputies processed Glover Palmer Smith just days ago -- taking a fresh mugshot.  Smith remains the prime suspect in the disappearance of his wife Marcie nearly five years ago, but has never been charged with murder.

The only hard piece of evidence in the case is surveillance video from a Walmart parking lot. It shows a man pulling a bicycle from Marcie's SUV the day she disappeared and riding away.  Police think that man was Palmer Smith.  Smith has always denied it.

Smith was convicted of lying to police and tampering with evidence in connection with the case. He was sentenced to one year in jail in 2010, but remained free on appeal until now.

This month, the Tennessee Court of Appeals ruled to "reinstate his convictions of fabricating evidence ... and the sentence." And the "appellant's remaining convictions and sentences for filing a false report are affirmed."

"The appellate court decision brings us one step closer to ensuring justice for the family of Marcie Smith," said Evans.

The appellate court ordered Smith rebooked at the jail to serve his sentence.  But, Smith's attorney said her client is frail and that spending a year in jail would be a death sentence.  So he's appealing to the state Supreme Court and after posting a $205,000 bond is free awaiting that court's decision.

Prosecutors said if the court declines to hear the case Smith will be sent back to serve his full sentence within 90 days.

Smith has always maintained he had absolutely nothing to do with the disappearance of his wife. His attorney said there is no evidence to prove otherwise.
