Charges Dropped Against Man Accused Of Rape

SPENCER, Tenn. – Prosecutors in Van Buren County dropped all charges against a man accused of raping a 5-year-old boy at Fall Creek Falls State Park last year.

Deputies said it happened in October, when they arrested 23-year-old Brandon Brownell for allegedly attacking the boy at the park.

However on Monday, the Van Buren District Attorney General said because Brownell has the IQ equivalent of a 2nd or 3rd grader, she had no choice but to drop the charges because he was unfit to stand trial.

It was a decision that angered the victim's relatives.

"I don't agree with that whatsoever," said Jonathan, the victim's stepfather.  "Even the detective that interviewed him said he was fine to stand trial, he didn't think there was anything wrong with him."

Brownell had been charged with Rape of a Minor, a class A felony, which would have meant a minimum sentence of 25 years behind bars had he been convicted.
