Sundquist Contracts Case Heads Back to Court

It's been a while since we heard much about the criminal investigation involving friends of former governor Don Sundquist -- and their lucrative state contracts.

But it's not over.

One close friend of former Governor Don Sundquist is in federal prison, as is a former member of the governor's administration.

This week, a case involving a third person goes before a federal appeals court.

That friend of the governor, Al Ganier, was all set to go on trial last year.

Ganier is charged with deleting computer files to obstruct the federal investigation into his own state contract.

Then, the night before trial, prosecutors revealed they had come up with new, potentially damaging evidence from his company's computers.

Ganier's lawyers convinced the judge that it was too late to spring the evidence on their client.

Prosecutors -- feeling it was such strong proof of guilt -- decided to halt the trial and appeal that decision.

This week, Ganier's lawyers will ask the federal appeals court in Cincinnati to keep the evidence out for good.

Ironically, they've now had more than enough time to review the new evidence.

So what's the point in fighting over the timing of evidence discovered more than a year ago?

Ganier's lawyers say the rules are the rules.

But it's probably also a pretty good clue that this evidence is something they'd rather a jury not see.
