TBI Says A.G. Blocked Release of Cooley File

Earlier this week, our chief investigative reporter Phil Williams first revealed that someone was trying to subpoena the TBI's file on a top Bredesen administration official.

Now, the state attorney general is trying to keep that file secret.

But there are questions about whose really behind those efforts.

Again, Phil has The Inside Story:

So who is Attorney General Paul Summers' office representing anyway?

Is it the Tennessee Bureau of Investigation? Or is it deputy governor Dave Cooley and his boss, Phil Bredesen? Or is Summers looking out for himself?

It all involves a traffic stop two years ago involving the deputy governor.

Cooley got a speeding ticket, then a Highway Patrol supervisor got it taken care of.

After the TBI investigated the deputy governor's great luck, the state attorney general personally decided not to prosecute any one for the ticket fixing.

But now, facing a subpoena for Cooley's TBI file as part of a lawsuit filed by a former trooper, Summers' office has sent the trooper's lawyer a letter saying:

"The Bureau objects."

So, what does the TBI say?

"The TBI has received notice from the state Attorney General that they object to the release of this file, and we have honored their objection by not releasing it," a spokesperson told me.

"If the courts deem this file a public record, it will be released.  Until that happens, we will honor the request of the state Attorney General not to release it."

In fact, as the lawyer for the former trooper suggests, the TBI routinely turns over its closed files in response to subpoenas issued as part of pending lawsuits.

But if that file involves the deputy governor, apparently that's a different story.
