An $18 million lawsuit has been filed in a crash that killed a TDOT worker and injured three others.

The suit was filed against the truck driver that hit the workers and a Texas trucking company.

The victim, David Younger's, milling and paving crew stopped on the shoulder of I-40 in April to change a flat tire.
That's when a tractor trailer hit them.

Attorneys said an investigation found the truck driver was speeding and had been swerving just before the deadly wreck.

The lawsuit was filed in Hickman County Monday, and claimed the driver was running two active log books.
Normally, drivers have one log book to record driving time to make sure they are sticking to a safe amount of hours on the roadways.

Attorney's also said it’s a pattern with the Texas trucking company which has been cited more than 60 times for "out of service" drivers.
