Attorneys spar over evidence in decommissioned officer Delke's murder case

NASHVILLE, Tenn. — Defense attorneys in the case of decommissioned officer Andrew Delke charged with murder filed a motion asking that discovery in the case be sealed.

They argue that some of the evidence material could be prejudicial and inadmissible at trial.

The defense also worries that releasing all the evidence for public consumption could influence witnesses who remember something only because they saw it on the news.

Prosecutors disagree and argue that the entire case should be open and transparent to the public.

They say that is all the more important because of actions by the Fraternal Order of Police which "announced it will mount a digital campaign in support of the defendant."

The District Attorney alleges that campaign includes "misinformation, mistruths and untruths."

Judge Monte Watkins will also consider that motion at a hearing next Tuesday.

On the same day of this filing, prosecutors filed a motion for Delke's two defense attorneys to recuse themselves over a "conflict of interest."
