A motion hearing was held for Brandon Vandenburg one week before his retrial was expected to begin.
Vandenburg was one of four former Vanderbilt University football players accused of raping a female student in a campus dorm back in 2013.
Both he and Cory Batey were convicted last year, but the verdict was thrown out after a mistrial was declared. Batey was convicted a second time back in April.
During a motion hearing held Monday morning, Judge Monte Watkins heard the defense's request for the state to provide all of the digital media evidence. However, that motion was denied.
Vandenburg's defense will also be bringing in an expert witness to rebut testimony of Det. Gish, who found video of the alleged rape on a cell phone.
His attorney has also requested raw data and media from all of the cell phones and computers collected during the rape investigation.
Vandenburg's re-trial was set to begin Monday, June 13. Jury selection would be conducted this week in Memphis.
