State Files Motion For New Sentencing Hearing In Batey Case

The state has filed a motion for a new sentencing hearing for Cory Batey.

In the motion filed August 15, the Office of the District Attorney said they weren’t notified of the letters given before the court on behalf of Batey prior to his original sentencing.

The defense never introduced the documents, nor did the state have access them.

The motion said several of the letters contradicted the state’s arguments during sentencing  – adding that, “notice to both parties is required when letters of support are sent directly to the court.”

As a result, prosecutors have asked for a new sentencing hearing and also review whether a different judge is necessary. 

Batey was sentenced to 15 years in prison back in July.  

The motion for the new sentencing is expected to be heard on Thursday.
