Former Sheriff To Get New Trial In 2012 Shooting Case

A former sheriff will get a new trial for a 2012 shooting charge after the Tennessee Supreme Court declined to hear an appeal from prosecutors.

The Jackson Sun reported former Henderson County Sheriff Ricky Lunsford was convicted on charges he shot at and attempted to kill his wife Mary Lunsford. The Tennessee Court of Appeals overturned Lunsford's conviction and ordered a new trial.

Prosecutors appealed, but on Thursday the state Supreme Court declined to hear the case, allowing the appeals court ruling to stand.

The appeals court overturned the conviction on the grounds that the trial court failed to properly instruct the jury that Mary Lunsford had previously faced a domestic assault charge.
