Law Center To Sue Tennessee Valley Authority

Those with the Southern Environmental Law Center said they intend to sue the Tennessee Valley Authority, alleging the authority has knowingly stored toxic waste in unlined pits for more than 40 years.

Media outlets reported the lawsuit, announced Thursday, would be on behalf of the Tennessee chapter of the Sierra Club over alleged violations of the Clean Water Act at the TVA's Cumberland Fossil Plant in Cumberland City.

The law center said TVA's own reports indicated that it knowingly stored 40 years of toxic coal ash waste at the Cumberland power plant in bedrock known to be fractured and unpredictable and without any type of protective lining.

TVA spokesman Scott Brooks said TVA officials will investigate the allegations. He added that environmental stewardship has been a "top priority" for the TVA.
