Legal Ruling Likely Opens Door To Plea Deal In Vanderbilt Rape Case
The case stemmed from the 2013 rape of an unconscious woman inside a Vanderbilt dorm room.
Corey Batey and Brandon Vanderburg, who were also arrested for the rape, have both been convicted and sentenced.
A video taken that night by the men, along with other evidence, led to 15 and 17 year sentences for those men, respectively.
McKenzie testified for the prosecution during the trial. Until now, he and Banks have been free on bond.
NewsChannel 5 recently learned this week Banks may take his chances at trial.
If the case does go to trial, his alleged victim will also be there. She has testified at all trials for the defendants.
If convicted or he agrees to a plea deal, Banks will do prison time and also become a felon and go on the sex offender registry.
Both Banks and McKenzie have been set to go to trial on June 19.
