Judge To Rule Whether Sheriff Heads To Jail

A federal judge is expected to decide whether Rutherford County Sheriff Robert Arnold will spend the next five months in jail as he awaits trial on fraud charges.

During an hours-long court hearing on Tuesday, prosecutors said Arnold assaulted his wife on Labor Day and violated the terms of his pre-trial release. 

The judge said she had a massive amount of evidence to consider and would deliver the ruling at 10 a.m.

In court, they played phone recordings, made by his wife's alleged boyfriend, that said Arnold punched her in the arm and threatened to suffocate her. 

Arnold was not formally charged with a crime related to the alleged assault but prosecutors argue their evidence shows Arnold is a danger to others.

He dodged NewsChannel 5's questions Tuesday night after 6 hours of arguments.

Arnold faces a federal trial next year related to the unlawful sale of e-Cigarettes at the county jail.

As part of his release, he agreed to not commit a federal, state or local crime while out on release.
