Motions Hearing Held In Vandenburg Retrial

A motions hearing was held in the retrial of Brandon Vandenburg. 

Judge Monte Watkins began hearing motions at 9 a.m. Friday in Nashville.  

Vandenburg's retrial was scheduled to start in June.  

Corey Batey could be a key part of his conviction. Batey was already convicted for his part in the rape of an unconscious woman on Vanderbilt University's campus.  

He could be a key witness against Vandenburg.

Batey's sentencing has been delayed and some wonder if that's confirmation he'll take the stand.

His attorney, Courtney Teasley, said she doesn't see a scenario where her client would point the finger at his former teammate.

“I definitely don't think that would be a recommendation from me for him to testify,” she said.

There's no indication yet that the District Attorney’s Office wants or needs Batey at trial.

Meanwhile, Teasley believes testifying could hurt Batey on appeal.
