A group of citizens in Rutherford County filed a lawsuit to remove jailed Sheriff Robert Arnold from office.
Attorneys for a group of 12 citizens filed the ouster suit Thursday night.
Arnold was recently arrested after a judge ruled to revoke his pretrial release after allegations of domestic assault against his wife surfaced, saying he violated the terms of the release.
Arnold refused to resign for office, therefore is expected to remain behind bars until he goes to trial for for his alleged involvement in the JailCigs fraud case.
In the meantime, the county must still send Arnold a paycheck - even while in jail. The citizens are hoping the ouster suit will put an end to that.
This civil case sites Arnold's federal case, the judge's decision to revoke his bond and keep him behind bar while awaiting trial and domestic violence charges.
The Rutherford County district attorney said he chose not to file an ouster lawsuit Due to the pending federal case.
No court date has been set to hear this civil case. However, by law, once Arnold is served this lawsuit he has 30 days to respond.
