NASHVILLE, Tenn. (WTVF) — Mike had a question and thought others might want to know the answer too.
The Nashville-area Kroger pharmacy customer emailed me after learning Kroger had settled a class action lawsuit accusing the company of overcharging insured customers for certain drugs. His question was simple: Could he get money back, and if so, how does he file a claim?
The lawsuit alleges some insured Kroger customers paid more out of their own pockets for certain prescriptions because Kroger did not account for lower savings club prices when reporting drug prices to insurers. Kroger denies the allegations but agreed to a $17 million settlement to resolve the claims.
Many customers received a claim form directly because Kroger and its other brands identified them as a pharmacy customer between Dec. 9, 2018, and Aug. 23, 2026.
Those who didn't can download the Claim Form on the official settlement claims website, KrogerSavingsClubSettlement.com. That is also where answers to many questions about the federal class action lawsuit are available. The documentation a customer needs to include depends on how they learned about the settlement and how much they spent. Customers who received a notice in the mail likely have their records already on file with Kroger. Customers who did not receive a notice, or who are claiming more than $8,000 in purchases, will likely need to provide proof such as pharmacy receipts or insurance documents.
The deadline to file a claim is December 21, 2026.
If your claim is approved, you won’t necessarily get paid right away. The court first has to give the settlement final approval. Once the settlement officially takes effect, payments to eligible class members are expected to be distributed within 120 days.
