NASHVILLE, Tenn. (WTVF) — A motion has been filed to dismiss a lawsuit against Metro Nashville. The lawsuit was originally filed for sending first responders to the wrong Waffle House location during the deadly Murfreesboro Pike shooting last year.
The lawsuit was filed by the family of Akilah DaSilva, one of the victims of the shooting. Shaundelle Brooks, DaSilva's next-of-kin, is listed as the plaintiff in the suit.
According to court documents, the lawsuit should be dismissed for several reasons. Among them is that Metropolitan Government is immune from suit for providing 911 services. The documents also state Brooks failed to provide sufficient facts to prove gross negligence or reckless conduct by 911 operators.
